Terms and conditions of sale
These general terms and conditions of sale are intended to define the contractual relationship between Le temple des Essences and any individual or legal entity wishing to make a purchase via the website, hereinafter referred to as “the buyer”. They are applicable to all purchases made through the site.
Temple des Essences reserves the right to modify its terms and conditions of sale at any time. In this case, the applicable conditions will be those in force at the date of the order by the Buyer.
The present contract is governed by French law. The Courts of the registered office of Le temple des Essences have exclusive jurisdiction.
Article 1 – Acceptance of these terms and conditions of sale
The fact that the buyer confirms his order on the site of Le temple des Essences, by clicking on the button “Confirm my order”, implies unreserved acceptance of these conditions. These general conditions of sale will prevail over any other general or particular conditions not expressly approved by Le temple des Essences.
Article 2 – Ordering
The information provided by the purchaser when placing an order is binding. In the event of an error in the recipient’s contact details, the seller cannot be held responsible for the impossibility of delivering the product(s). The seller cannot be held responsible for any damage resulting from the use of the Internet, such as loss of data, intrusion, virus, service interruption or other involuntary problems. All our offers are non-binding and subject to availability, from Landonvillers. Each order placed by the purchaser will be confirmed by the seller by the issue of an invoice. Orders placed without confirmation from Le Temple des Essences are not a guarantee of delivery.
Article 3 – Delivery and acceptance
Products are delivered in cardboard boxes to a single address. Shipping costs are charged at a single flat rate. An invoice will be sent to you by e-mail. The order will be shipped upon receipt of the corresponding payment. Any delays do not entitle the buyer to cancel the sale, refuse the goods or claim damages. Goods always travel at the recipient’s risk. The buyer must always check his parcel on arrival. The buyer has 48 hours to notify the carrier of any reservations in the event of shortages or damage.
Article 4 – Withdrawal
In application of the French Consumer Code, the buyer has a period of 7 clear days from delivery of the order to return the product to the seller for exchange or reimbursement, without penalty except for the cost of return.
Article 5 – The price
Prices on the site are in euros and include VAT. The price indicated on the product sheets does not include transport. The price indicated in the order confirmation by Le temple des Essences is final. This price includes the price of the products, handling, packaging and storage costs. Shipping costs, customs taxes and formalities are the exclusive responsibility of the customer.
Article 6 – Regulations
Payment for products can be made via a Paypal account or by credit card. An invoice including VAT will be established by Le temple des Essences and sent to the customer’s billing address.
Le temple des Essences reserves the right to cancel any confirmed order that has not been paid within 7 days of the invoice date.
Le temple des Essences does not accept payment in instalments or payment within 30 days.
Article 7 – Reservation of ownership
All goods remain the property of Le temple des Essences wherever they may be until invoices have been paid in full.
Article 8 – Disputes
Complaints or disputes will always be received with attentive benevolence, good faith always being presumed in those who take the trouble to explain their situation. In the event of a dispute, the customer should first contact the company for an amicable solution. Failing this, the courts of Metz shall have sole jurisdiction, irrespective of the place of delivery and the method of payment accepted.
Article 9 – Legal information
In accordance with the law relating to data processing, data files and individual liberties n°75-17 of January 6, 1978, nominative information relating to purchasers may be subject to automated processing. The seller reserves the right to collect information on buyers, including by using cookies. The buyer has the right to access, rectify or delete personal data concerning him/her. They may exercise this right by sending a letter to Le temple des Essences – 14 Allée des Tilleuls – 57530 Landonvillers. The information collected is intended for Le temple des Essences. No personal information is passed on to third parties.
Le temple des Essences does not sell or rent e-mail addresses or personal information concerning its customers.
All elements of the Seller’s site are and remain the exclusive intellectual property of Le temple des Essences. No one is authorized to reproduce, exploit, rebroadcast or use for any purpose whatsoever, even partially, elements of the site whether software, visual, textual or audio. Any simple link or hypertext link is strictly forbidden without the express prior consent of Le temple des Essences.
